These Terms of Use ("Terms" or "EULA") govern your use of the Budtrack mobile application and related services ("Service" or "Licensed Application") provided by Budtrack ("we," "our," or "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You acknowledge that this EULA is concluded between you and Budtrack only, and not with Apple Inc. ("Apple"). Budtrack, not Apple, is solely responsible for the Licensed Application and the content thereof. This EULA may not provide for usage rules for the Licensed Application that conflict with the Apple Media Services Terms and Conditions (which you acknowledge you have had the opportunity to review).
The license granted to you for the Licensed Application is limited to a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that such Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
Budtrack is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA or as required under applicable law. You and Budtrack acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
Budtrack is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Budtrack's sole responsibility.
You and Budtrack acknowledge that Budtrack, not Apple, is responsible for addressing any claims of yours or any third party relating to the Licensed Application or your possession and/or use of that Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. This EULA may not limit Budtrack's liability to you beyond what is permitted by applicable law.
You and Budtrack acknowledge that, in the event of any third party claim that the Licensed Application or your possession and use of that Licensed Application infringes that third party's intellectual property rights, Budtrack, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third party terms of agreement when using the Licensed Application (e.g., you must not be in violation of your wireless data service agreement when using the Licensed Application).
You and Budtrack acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third party beneficiary thereof.
Budtrack is a personal budgeting application that helps you track spending, set budgets, and manage your finances. The Service includes free features and optional Premium features available through in-app subscription. Premium features include bank account linking, AI spending insights, subscription and recurring payment tracking, budget streak tracking, and bank-level security.
You must be at least 13 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when creating an account and to update it as needed.
Subscription Plans: Budtrack offers auto-renewable Premium subscriptions:
Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
Cancellation: You may cancel your subscription at any time through your device's subscription settings (Settings → [Your Name] → Subscriptions on iOS, or Google Play Store → Subscriptions on Android). Cancellation takes effect at the end of the current billing period; no refunds are provided for partial periods.
Price Changes: We may change subscription prices with reasonable notice. Continued use after a price change constitutes acceptance of the new price.
You agree to use the Service only for lawful purposes. You will not:
When you connect your bank account through Plaid or other third-party providers, you are subject to their terms and privacy policies. We do not store your bank login credentials. We receive transaction data to provide the Service. We are not responsible for the accuracy of data provided by third parties or for any actions taken based on that data.
The Service, including its design, features, and content (excluding your data), is owned by Budtrack and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. BUDTRACK IS A BUDGETING TOOL AND DOES NOT PROVIDE FINANCIAL, TAX, OR INVESTMENT ADVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUDTRACK AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.
These Terms are governed by the laws of Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Canada.
